These Terms and Conditions ("T&C") govern the rights and obligations arising from the relationship between Adrop s.r.o., a travel agency, with registered office at Vinohradská 2165/48, 120 00 Prague 2, ID No. 27312925, registered in the Commercial Register maintained by the Municipal Court in Prague, Insert C, Section 152307 ("Adrop" or "Administrator") and the Client or a third party in the mediation of tours by travel agencies ("Mediation Contract").
If the party to the Agency Contract is a consumer, the Agency Contract is also governed by Act No. 89/2012 Coll., the Civil Code, as amended (the "CC"), and Act No. 634/1992 Coll., the Consumer Protection Act, as amended. If the consumer is not a party to the contract, the relationship is governed by the CC.
Adrop informs that there are no restrictions on the provision of the tour, unless otherwise stated for the individual offer in the online shop or unless the travel agency stipulates otherwise. Adrop does not charge any additional fees for means of distance communication or similar payments, but charges the cost of delivery of the gift voucher. The tour voucher sent by Adrop in a gift package to the Customer or a third party may not cover the full cost of the tour. Prices are quoted in CZK including all charges as stipulated by law.
The validity of the voucher and the mediation contract are terminated upon completion of the tour, cancellation of the mediation contract or expiry of the voucher.
If the customer incorrectly provides his/her e-mail or the e-mail of a third party when ordering or booking the tour, Adrop shall not be liable to the customer or the client for any damage caused by the non-delivery, even if the e-mail is returned as undeliverable.
1.1 The Customer is the person who intends to conclude or will conclude a travel contract with the travel agency.
1.2 The customer is the customer or a third party for whose benefit the contract has been concluded and who has consented to it, or a third party to whom the contract has been transferred.
1.3 A consumer is any person who, outside the scope of his business or the independent exercise of his profession, enters into a contract with Adrop or otherwise deals with it.
1.4 A tour is defined in accordance with Act No. 159/1999 Coll., on Certain Conditions of Business and on the Performance of Certain Activities in the Field of Tourism, as amended (the "Act"), and Sections 2521 et seq. of the CC, as a set of tourism services pursuant to the Act, or individual tourism services provided by the organizing CK.
1.5 A tour operator is a tour operator within the meaning of the Act.
1.6 Online shop means the website www.adrop.cz, on which the customer can purchase and the customer can book a tour.
1.7 Voucher is a proof of the conclusion of an agency contract and a proof of partial payment of the tour price in the amount indicated on the voucher.
1.8 A gift package is a package containing a voucher, these OP and a cancellation form sent by Adrop to the Customer or a third party after the order has been placed.
2.1 In accordance with the EU Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data ("Regulation" or "GDPR"), the Controller hereby informs that for the performance of a contract, for the implementation of pre-contractual measures, for the fulfilment of a legal obligation or for reasons of legitimate interest of the Controller ("Legal Processing Reason"), the Controller will process the personal data of the Customer and the Customer in the following scope: name, surname, date of birth, residence, email address, telephone ("PI"). PI are address and identification categories.
2.2 The Controller informs that the PII will be processed for the purpose of: recording, processing and dispatching the order, making the booking, informing the travel agent in relation to the performance of the agency contract ("Purpose"), based on a Legal Reason for Processing. The Controller informs that the following categories of recipients are among the other recipients of OU: the Controller's accounting advisor, the Controller's tax advisor, the Controller's service provider, the Controller's IT specialist, travel agencies cooperating with the Controller and other OU processors with whom the Controller has concluded an OU processing agreement ("Processor") and the carrier or postal licensee.
2.3 The Controller informs that it will process OA for the duration of the Mediation Contract and for a further 3 years after the end of the contract.
2.4 The Controller informs that the Customer or Client has the right to (i) request from the Controller access to the PII, (ii) rectification of the PII, (iii) erasure of the PII, (iv) restriction of the processing of the PII, (v) object to the processing of the PII and (vi) to the portability of the PII (i.e. to obtain the PII from the Controller in a structured, commonly used and machine-readable format and transmit it to another controller). The Controller further informs that (i) consent may be withdrawn if the data subject provides the PII with consent, (ii) to file a complaint with the Office for Personal Data Protection, at Pplk. Sochora 27, 170 00 Prague 7, official www: https://www.uoou.cz, (iii) that the provision of PII is not an obligation, and (iv) that there is no automated decision-making or profiling. The Controller informs that the Client or Customer has the right to obtain from the Controller confirmation of whether or not the PII is processed or copies of the processed PII. Requests, objections, exercise of rights can be sent to the Administrator's registered office or to the following e-mail address: gdpr@adrop.cz
2.5. The Controller further discloses that the Client or Customer has the right to erasure of the PII if (i) the PII is no longer necessary for the Purpose, (ii) the Client withdraws consent and there is no further legal basis for the processing, (iii) objects to the processing of PI processed on the basis of a legitimate interest of the Controller or objects to automated individual decision-making or profiling, (iv) the PI has been processed unlawfully, (v) the PI must be deleted to comply with a legal obligation, (vi) the PI has been collected in connection with commercial communications.
2.6 The Controller expressly points out that the Customer or Client has the right to object at any time to (i) the processing of PI concerning him/her which was obtained for the performance of a task in the public interest or on the basis of a legitimate interest of the Controller, including profiling based on these grounds, or (ii) the processing of PI for direct marketing. The Controller points out that the Client or Customer has the right not to be subject to any decision based solely on automated processing, including profiling, which has legal effects for him or significantly affects him, unless it is necessary for the conclusion or performance of a contract or is based on his express consent.
2.7 The Online Shop uses cookies to personalise advertisements and to analyse traffic. By using the online shop, you consent to the use of cookies.
3.1 The subject matter of this contract is Adrop's obligation to arrange for the customer to contact the travel agent, to provide an online shop to make payment for the voucher and to provide an online shop for booking the tour.
3.2 The subject of the contract is also Adrop's obligation to receive messages, requests or complaints from the customer regarding the tour and to forward them without undue delay to the tour operator. Adrop operates a telephone number 484 800 980 and an e-mail info@adrop.cz for handling requests and complaints.
3.3 The order is a proposal for the conclusion of a mediation contract. The order can be made
by using the order form in the online shop,
by e-mail,
by telephone,
in person.
3.4 Before ordering a voucher, the Customer is obliged to confirm by ticking the box in the order form that he/she has read the documents:
3.5 The mediation contract is concluded by the confirmation of the order by Adrop. If the mediation contract is concluded for the benefit of a third party, the third party only becomes the beneficiary when he agrees to the mediation contract. The Customer is obliged to inform the third party of the mediation contract, the Tour Information and the legal protection provided before the conclusion of the tour contract and these T&C. Until consent is given, the client has the right to the performance.
3.6 Adrop undertakes to deliver the gift package to the Client or the Customer at the place specified by the Client in the order as the place of delivery. The delivery of the gift package shall be deemed to be the receipt of the gift package by the Customer or the Client or any other authorised person present at the place of delivery at the time of delivery. The person taking delivery shall acknowledge receipt of the gift package by signing.
3.7 The period of validity of the voucher is indicated on the voucher. After the expiry of the voucher, the client or customer loses the right to book the tour. The validity of the voucher can be extended for a further 6 months at a price of 690 CZK or for a further 1 year at a price of 990 CZK, and only once. The voucher cannot be exchanged for money.
3.8. The agreement on the extension of the voucher validity must be concluded no later than on the last day of the voucher validity. The agreement can be concluded in the online shop. Should the value of the voucher be changed after the voucher has been purchased, the customer is obliged to pay the difference in price to Adrop within 10 days of Adrop's invitation, otherwise the voucher will not be extended. Vouchers that have expired and have not been validly extended are forfeited and Adrop is not obliged to refund the price.
4.1 The price of the voucher is indicated in the online shop. The price can only be paid by the methods indicated in the online shop. Other payment methods, including cash payment, are only possible by prior agreement with Adrop. A flat fee will be added to the price of the voucher depending on the method of delivery of the gift package chosen, if delivery is ordered.
4.2 The Customer acknowledges that by paying the price, he/she receives a voucher for the tour in the value stated on the voucher. In the event that the Customer enters into a tour contract with a travel agency for a tour with a price higher than the value of the voucher, the Customer is obliged to pay the difference to the travel agency.
5.1 The order is dispatched within 3 working days after the following conditions have been met:
acceptance of the order and
receipt of payment of the price.
5.2 The carrier delivers gift packages on delivery or without delivery within 48 hours of dispatch. In the event that the carrier does not reach the customer or the person taking delivery at the place of delivery, the carrier shall contact the customer by telephone, in which case the 48-hour period shall not apply.
5.3 The Customer may, by agreement, collect the gift package at Adrop's registered office at any time during working hours, at the latest within 14 days after ordering.
5.4 Delivery by e-mail can be chosen if the online shop offers it.
6.1 The customer shall make a reservation proposal immediately after the delivery of the gift package in the online shop. The customer is obliged to tick the box on the order form before confirming the reservation, stating that he/she has read the documents:
the travel agency's terms and conditions
the travel agent's concession
proof of travel agency insurance.
6.2 Upon receipt of the booking proposal, Adrop will send a summary of the booking to the email provided by the Customer with the contact details of the travel agent.
6.3 The customer is obliged to conclude the tour contract and book a specific date directly with the travel agency and furthermore to comply with the travel agency's terms and conditions.
7.1 The customer may withdraw from the agency contract within 14 days of its conclusion, provided that he/she has not concluded the tour contract or booked the tour.
7.2 The customer may withdraw from the tour contract under the terms and conditions of the travel agency. Unless the reason for the customer's withdrawal is a breach of the travel agency's obligations under the travel contract or under the law, the customer is obliged to pay the travel agency a compensation according to the travel agency's terms and conditions.
7.3 The customer is also obliged to pay the severance payment if the tour operator withdraws from the tour for reasons of breach of duty by the customer.
8.1 The customer may notify the tour operator of proposed changes to the tour contract prior to the commencement of the tour. The customer may propose changes no later than the time limit specified in the tour operator's terms and conditions. The travel agency is not obliged to accept the proposed amendment unless the travel agency's terms and conditions or the law provides otherwise.
8.2 Cancellation of the tour may be made in writing under the terms and conditions of the travel agency.
8.3 All tours offered through Adrop are insured against bankruptcy of the travel agency. In the event that insolvency proceedings are initiated against the tour operator in the competent court, Adrop undertakes to return the funds in accordance with Act No. 182/2006 Coll., Insolvency Act, as amended. If it is necessary to recover the funds paid in the insolvency proceedings, Adrop shall refund to the customer the part of the funds paid that it receives in the insolvency proceedings, less the costs of recovery (if any).
9.1 The Customer must claim defects in the mediated services in writing to Adrop without undue delay after becoming aware of the reason for the claim, but at the latest within 30 days of the defect occurring. Later claims shall be rejected by Adrop.
9.2 The customer must submit the defects of the tour in writing to the tour operator without undue delay after becoming aware of the reason for the claim, within the time limit specified in the tour operator's terms and conditions. The customer is obliged to collect evidence of the defects (photographs, video recordings, testimonies, etc.) and submit them with the claim.
9.3 The Customer, who is a consumer, is entitled to contact the independent consumer dispute resolution centre of the Czech Trade Inspectorate (CTIA) in case of non-acceptance of the claim or any other dispute with Adrop and to initiate a free out-of-court negotiation process. Details of the conditions and how to initiate out-of-court negotiations are available at www.coi.cz.
10.1 The Customer is obliged to carry a valid passport or an ID card for travel within the Schengen area. The customer is obliged to find out the details related to entering the selected country or countries he/she is passing through during the land transport to the selected destination. The customer must arrange his/her own visa prior to departure. Adrop shall not be liable for any failure to grant a visa. The customer is aware that different destinations have different minimum passport validity (usually expressed in months after return from the destination). For most destinations this is a minimum validity of six (6) months. Customers of non-Czech citizenship are obliged to check passport, visa and other formalities for their stay in the respective destination, including in the countries of any transfers or crossings, before booking the tour.
10.2 In the event of loss of a travel document or an emergency situation, the customer may request assistance from the relevant Czech Embassy. The list of offices can be found on the website of the Ministry of Foreign Affairs in the chapter "Countries of the World - Travel Information", tab "Contact Czech Office".
10.3.
11.1 All materials and information in the online shop are the exclusive intellectual property of Adrop or persons cooperating with it. Such materials and information may not be used or modified without the consent of Adrop. The Online Shop may contain links to other third party websites. Adrop is not responsible for the content of other websites or the services offered on them. Photographs may differ for some services from the actual tour, but not the contracted content.
